GENERAL PROVISIONS

This Regulations document defines the rules for using the samway.eu website, owned by Hydron, with its registered office in Złotów at ul. Kujańska 6a, 77-400 Złotów, NIP: 7671616654, REGON: 387226885 (hereinafter referred to as the “Operator”).

The Website serves an informative and catalog function regarding the presentation of SAMWAY brand devices and accessories.

The content contained on the Website does not constitute a commercial offer within the meaning of Art. 66 § 1 of the Civil Code, but is an invitation to submit quote inquiries.

Using the Website is equivalent to accepting the provisions of these Regulations.

INTELLECTUAL PROPERTY PROTECTION

All materials posted on the Website, including technical descriptions, photos, graphics, and logos, are the property of the Operator or are used under relevant licenses.

It is prohibited to copy, modify, or distribute the content contained on the Website without the express written consent of the Operator, subject to rights granted to Business Partners through separate arrangements.

PROCEDURE FOR SUBMITTING INQUIRIES AND FULFILLING ORDERS

The user may submit quote inquiries electronically (via e-mail) or by telephone.

The quote inquiry should contain the exact technical data of the goods or their name, the ordering party’s details, and delivery details.

The offer prepared by the Operator is valid for the period specified therein.

The order is considered binding upon receipt by the Operator of the offer acceptance confirmation and (if necessary) making an advance payment to the indicated bank account.

The Operator reserves the right to verify the contractor’s data and to refuse order fulfillment in the event of product unavailability or technical obstacles.

RULES OF COOPERATION WITH BUSINESS PARTNERS

Permanent (wholesale) cooperation is dedicated to business entities operating in the hydraulic, technical, or machinery industry.

Business Partners are entitled to use dedicated price lists and marketing materials provided by the Operator.

The Operator provides Partners with full technical support and access to product certificates and declarations of conformity.

The rules regarding payment terms, discounts, and complaint procedures for Business Partners are regulated by separate agreements or commercial arrangements.

LIABILITY AND WARRANTY

The Operator exercises the utmost care to ensure that the technical information presented on the Website is consistent with the actual state of affairs. However, due to continuous technological development, device specifications are subject to change without prior notice.

The Operator shall not be liable for damages resulting from improper selection of the device by the User or use inconsistent with the Technical and Operational Documentation (DTR).

The warranty for products is granted under the terms specified by the manufacturer (WUXI SAMWAY CO. LTD).

COMPLAINT PROCEDURE

Complaints should be submitted in writing to the following address: sales@samway.eu.

The complaint should contain a description of the defect, the purchase invoice number, and photos/documentation confirming the submission.

The Operator undertakes to process the complaint within 14 business days.

The advertised goods must be delivered to the Operator’s registered office in their original packaging or secured in a way that guarantees transport safety.

DELIVERY AND TRANSPORT

Transport costs are determined on a case-by-case basis when placing an order.

The risk of accidental loss or damage to the goods passes to the Ordering Party upon release of the goods to the carrier.

It is the recipient’s duty to inspect the condition of the shipment in the presence of the courier. In the event of mechanical damage, it is necessary to draw up a damage report, which serves as the basis for acknowledging the complaint.

FINAL PROVISIONS

In matters not regulated by these Regulations, the provisions of the Civil Code and relevant acts of Polish law shall apply.

Any disputes arising from the performance of contracts shall be settled by the court competent for the Operator’s (Hydron) registered office.

The Operator reserves the right to amend the content of the Regulations. The amendments become effective on the day of their publication on the Website.
